As the economy starts to tighten up, Owners and General Contractors may be slow to make payment, even when the roofing contractor’s work has been completed and accepted.  In those instances, the roofing contractor needs to protect its entitlement to payment by recording a Claim of Lien against the project.  Unbeknownst to many roofing contractors, the right to record a Claim of Lien against the project can be lost during the course of the work if lien waivers are being executed and submitted with each pay application.  Further, lien rights do not run forever, and oftentimes, roofing contractors lose their lien rights by waiting too long to record their Claim of Lien.  All of this also applies to payment bond claims on public projects.  During this one our session, we will walk through Georgia’s lien and bond law, with an emphasis on how to avoid losing your lien rights or losing your payment bond claim.  And we will also touch on the legal implications of bid bonds for those roofing contractors bidding work directly to a public owner.
